CULINARY WORKSHOP REGULATIONS

I. INTRODUCTION

  1. These regulations (hereinafter referred to as “the Regulations”) define the rules of organising Culinary Workshops.
  2. The organiser of the culinary workshops (hereinafter referred to as “the Workshops”) is Body Chief Sp. z o. o. with its registered office in Wysogotowo, postcode 62-081, ul. Grzybowa 10 (Grzybowa 10 Street), entered into the register of entrepreneurs kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the number 0000713725, REGON (business entity identification number): 369298976, NIP (tax identification number): 779-247-98-25 (hereinafter referred to as “the Organiser”).
  3. When registering to participate in the Workshops, the Participant accepts the provisions of these Regulations. Failure to comply with the Regulations by the Participant may result in his or her exclusion from participation in the Workshops.
  4. If the Workshops are purchased by a person other than the Participant, the Participant is obliged to read and accept the content of these Regulations, which are made available to the Participant via email.
  5. These Regulations are available at www.bodychief.pl.
  6. These Regulations constitute an integral part of the registration to participate in the Workshops and apply to each Participant.

 

II. GENERAL PROVISIONS

  1. In order to participate in the Workshops one shall register and pay the fee in the amount specified by the Organiser.
  2. The Workshop Participant may be any natural person with full legal capacity, and also, in cases provided for by generally applicable regulations, a natural person with limited legal capacity who expresses willingness to participate and pays the fee for his or her participation in the Workshops in accordance with these Regulations. In the case referred to in point I section 4 above, the Participant for whom the Workshops were purchased must be reported and registered before the Workshops take place, and is also obliged to accept these Regulations.
  3. The Workshops are organised at the Organiser's headquarters, i.e. in Wysogotowo, postcode 62-081, in ul. Grzybowa 10 (Grzybowa 10 Street).
  4. The number of Participants taking part in the Workshops is limited and determined by the Organiser.
  5. The duration, the person conducting the Workshops and the subject of the Workshops are determined by the Organiser, who informs about them in the description of a given Workshop. The Organiser reserves the right to introduce modifications to the dishes which will be prepared as part of a given Workshop.
  6. The Organiser reserves the right to extend or shorten the Workshops, so that Participants can prepare the dishes planned.
  7. The Organiser informs that products which may cause allergic reactions in some people are used to prepare dishes during the Workshops (e.g. fruit, nuts, fish and seafood, etc.). Each Workshop Participant, aware of his or her health condition, declares to take this fact into account when he or she agrees to participate in the Workshop. While taking part in the Workshops, the Participant is obliged to follow dietary rules which do not pose a threat to his or her life and health. If you have any doubts about the content of the prepared dishes, please contact the Organiser. The Organiser reserves the right that the program (list of dishes) provided in the Workshop description does not contain a detailed description of the ingredients used to prepare the dishes.
  8. The Organiser is not responsible for the health condition of Workshop Participants or possible allergic reactions to prepared dishes.
  9. The Workshops have a practical learning nature. The Organiser ensures that the Participants will be provided with knowledge about the prepared dishes by the instructor and will gain practical experience in preparing them, as indicated in the description of the Workshops. The Organiser is not responsible for the extent to which knowledge and skills are acquired by the Participants.
  10. Only people who have paid the Workshop fee can stay in the premises where the Workshops are held. After making the purchase, successfully completing the registration process and paying for the Workshops, one receives a unique code from the Organiser entitling him or her to enter the Workshops. It is up to the buyer to decide whether he or she uses the code personally or passes it on to a third party. If the code in question is transferred, the purchaser is obliged to notify the Organiser of this fact no later than 24 hours in advance, indicating the name and surname and email address of the Participant.
  11. A Participant who is late for the Workshop takes part in it from the moment he or she arrives at the Workshop. The instructor is not obliged to repeat the previously conducted part of the Workshop.
  12. If the Workshops are recorded using image and sound recording devices by a person authorised by the Organiser, the Participant consents to this action without any claims. Before starting the Workshop, the Participant consents in writing to the use of his or her image in the case of publishing photos and videos by the Organiser on social media and on the website.

 

III. ORGANISER'S OBLIGATIONS

  1. The Organiser informs that products which may cause allergic reactions in some people (e.g. nuts, fish, gluten, etc.) are used in the process of dish preparation at the Workshops. Each Participant, aware of his or her health condition, shall inform the Organiser in the health declaration about any allergies and/or diseases that may affect his or her health condition.
  2. The Organiser is not liable to the Participant for failure to perform any obligations arising from these Regulations to the extent which is caused by the occurrence of "Force Majeure", i.e. events beyond the Organiser's control, including, but not limited to, a random event, war, uprising, riots, acts of terrorism, fire, explosion, flood, theft of important equipment, intentional damage, cyber attack, strike, lock-out, weather conditions, security for a third party, requirements resulting from national defense, acts and regulations of state or local government administration bodies.
  3. The company possesses liability insurance for the organisation and implementation of Workshops.

 

IV. PARTICIPANT'S OBLIGATIONS

  1. The Participant is obliged to follow the recommendations of the Workshop instructor and the health and safety rules applicable at the place where the Workshops are organised.
  2. The Participant working in contact with food shall maintain a high degree of personal cleanliness and wear protective outer clothing (apron). It is significant to keep long hair tied up so that it does not come into contact with food.
  3. The Participant is obliged to inform the Organiser about any infectious diseases (e.g. jaundice) he or she is aware of, as well as about any allergies and health contraindications which might be important for his or her health during the Workshops in which he or she participates. If the Participant suffers from infectious diseases or other diseases that may pose a threat to other Workshop Participants, then he or she is not entitled to take part in the Workshops and the participation fee is not refunded.
  4. The Participant keeps the workplace and the equipment and devices used during the Workshops clean.
  5. The Participant uses all appliances in accordance with their operating instructions. The instructions are available to view by Participants at the place where the Workshops are held. In case of doubts regarding the use of a given device, the Organiser provides technical support.
  6. The Participant is responsible for damage caused to himself/herself or other Participants during the Workshops, which is the result of his or her negligence or careless or reckless behaviour.
  7. The person operating equipment, tools or devices is responsible for their destruction or damage. The operator is not responsible for the natural wear and tear of the equipment or its technical defects.
  8. The Participant cannot use his or her own food, drinks or tools during the Workshops unless the Organiser consents.

 

V. SERVICE PURCHASE

  1. The Participant registers for the selected Workshop and Workshop date by sending an email to the following address: [email protected].
  2. The application includes the following data: name and surname, name/subject of the Workshops, date and time of the Workshops. If the Participant reserves several places, he or she states the number of places in the application.
  3. By sending an email application, the Participant declares that the data provided therein is complete and consistent with the actual situation and consents to their processing for the purpose of executing and servicing the order by the Organiser, who is also the data administrator, in accordance with the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Personal data provided by the Participant (name, surname, address, telephone number, email address) are treated as confidential information and are used only for the purposes of communication between the Participant and the Workshop Organiser.
  4. The Organiser confirms the reservation by sending an email to the Participant. In the email the Organiser provides detailed information necessary to make the payment. At the same time, along with the payment information, the Organiser sends the Participant a health condition form, which shall be sent back to the Organiser's email address. Providing information about the health condition depends only on the Participant's decision, while the processing of health data in accordance with point VII section 6 of the Regulations may only take place with the prior consent of the Participant.
  5. The initial reservation of a place is valid for 3 days from the moment of receiving the email from the Organiser referred to in point 4 above. During this time a transfer for Workshop participation shall be made. The title of the transfer shall include the name, surname, date and name of the Workshop.
  6. The service is purchased after the Participant makes a payment to the Organiser's bank account. The prices of all Workshops are gross prices per person.
  7. By purchasing participation in the Workshops, the Participant accepts the rules of their organisation described in detail in the Regulations available at: www.bodychief.pl and received by email.
  8. Organiser's bank account number: 95 2490 0005 0000 4600 0002 9562.
  9. Lack of payment within the required period of 3 days from the moment of receiving the email means that the Participant has resigned from participating in the Workshops and treats the initial reservation as null and void.
  10. The Participant who purchased the service of participation in the Workshops is informed by email by the Organiser about the acceptance of the application and the acceptance of payment.
  11. Participation in the Workshops depends on the order of applications and payments.
  12. The fee for Workshop participation includes:

a)   group classes with an instructor,

b)   access to all food products necessary to prepare meals,

c)    use of all kitchen equipment provided by the Organiser,

d)   access to recipes of dishes covered by a given Workshop,

e)   use of water, coffee and tea during the Workshops (or other drinks included in the description of a given Workshop),

f)     opportunity to taste dishes prepared during the Workshops,

g)   providing a chef's apron.

  1. The fee for Workshop participation does not include in particular:

a)   costs of travel to the place where the Workshops are organised;

b)   accommodation costs.

  1. The costs referred to in section 13 above are covered by the Participant on his or her own.
  2. The Organiser declares that the fee for workshop participation does not include the costs of using alcoholic beverages.

 

VI. RESIGNATION, CANCELLATION OF WORKSHOPS

  1. The service offered by the Organiser is a food and entertainment service, therefore the Participant who is a consumer is not entitled to withdraw from the contract in accordance with Art. 38 section 1 point 12 of the Act of May 30, 2014 on consumer rights (consolidated text: Journal of Laws of 2020, item 287, as amended), there is no right to withdraw from the contract without giving a reason.
  2. The Participant has the right to resign from the Workshops he or she has paid for.
  3. Notification of resignation must be sent in writing, no later than 14 days before the date of the Workshops, to the email address: [email protected]. One is obliged to provide in the email their name and surname and the date of the classes they are withdrawing from.
  4. Workshop fee is returned by transfer to the account from which the payment was made within 7 days from the date of Participant’s resignation, in the case of resignation notified within the deadline specified in section 2 above.
  5. If the Participant fails to meet the deadline referred to in section 2 or in the case of the Participant's absence at the Workshops, the payment is lost.
  6. If the Participant is unable to participate in the purchased Workshops, he or she may indicate another person who will participate in these Workshops instead. The Participant is obliged to inform the Organiser about such changes by email to [email protected] no later than 1 (one) day before the beginning of the Workshops to which the change applies. Participation of the replacing person in the Workshops is possible after reading and accepting these Regulations.
  7. The Organiser reserves the right to cancel or postpone the Workshop to another date due to failure to meet the minimum number of participants specified in the Workshop description or due to reasons beyond their control.
  8. When canceling the Workshop, the Organiser may propose to the Participant a different date of the Workshop or a different subject of the Workshop. If the Participant does not consent to the change, the Organiser refunds the fee paid by the Participant immediately, but no later than within 7 days. The fee is refunded to the bank account number from which the payment was made.
  9. Rules for using the voucher entitling to participate in the Culinary Workshops:

a)   When completing the Order for participation in the Culinary Workshops, the Participant may provide his or her voucher code. In order to use it, it is necessary to provide the voucher code in the application form. In the case of an Order placed via email, the Participant provides the voucher code in the email.

b)   The voucher is a gift card with a value marked on it, entitling the Participant to use it to pay for participation in the Culinary Workshops in accordance with these Regulations, the conditions specified therein and the value specified on it. The voucher is not a Service, but only a document entitling the Participant to use it while paying for participation in the Culinary Workshops.

c)    The holder of the voucher is entitled to a single use, in accordance with these Regulations, the conditions specified therein and the value specified on it, by purchasing the Service in accordance with these Regulations, subject to the following rule. If the entire value of a given paid voucher is not used in a single use, its holder may re-use it until the entire value of the given voucher is used up in accordance with the conditions specified therein.

d)   The Voucher replaces cash with the value specified on it for the purpose of making payment for the Service, but is not exchangeable for cash itself.

e)   The Participant has the right to redeem the voucher also in the case of a Service the value of which exceeds the nominal value of the voucher, provided that in such a case the Participant pays the remaining part of the price. In the case of a Service the value of which is lower than the value marked on the voucher, the Participant is not entitled to receive funds constituting the difference between the value of the Service and the value specified on the voucher. If the entire value of a given voucher is not used in a single use, its holder may re-use it until the entire value of the given voucher is used up in accordance with the conditions specified therein.

 

VII. PERSONAL DATA, PRIVACY POLICY

  1. The administrator of personal data processed with regard to the implementation of the provisions of these Regulations is the Organiser.

  3. Personal data are processed by the Administrator in accordance with applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as "GDPR" or "GDPR Regulation".
  4. The Administrator processes personal data for the purposes, within the scope, on the basis and on the principles indicated in this section of the Regulations. Providing personal data is voluntary, however, not providing personal data necessary to purchase Workshops results in a refusal to purchase the Workshops.
  5. The purpose of the Participant's personal data processing by the Administrator is the correct implementation and settlement of the Workshops. The basis for the processing of the Participant's personal data is the need to conduct the Workshops (Article 6 section 1 point a) and c) of the GDPR).
  6. With regard to the implementation of the Workshops, the Administrator may process the following data of Participants: name and surname, email address, bank account address, telephone number and special category data (health data). Special category data may be processed in accordance with Art. 9 section 2 point a) of the GDPR, based on the consent expressed by the Participant.
  7. The data is stored for the period necessary to conduct the Workshops and for the period provided for archiving tax documents.
  8. The recipients of the data may be accounting service providers assuring the Administrator accounting support (in particular an accounting office) when purchasing Workshops. The Administrator makes the collected Customer’s personal data available to a selected provider acting on the Administrator’s behalf only in the case and to the extent necessary to achieve a given purpose of data processing in accordance with these Regulations.
  9. Rights of the data subject:

a)   the right to access, rectify, restrict, delete or transfer - the data subject has the right to request from the Administrator access to his or her personal data, rectify them, delete them ("right to be forgotten") or limit their processing, the right to object to processing and the right to transfer his or her data. Detailed conditions for exercising the above-mentioned rights are indicated in Art. 15-21 of the GDPR Regulations;

b)   the right to lodge a complaint with the supervisory authority - the person whose data are processed by the Administrator has the right to lodge a complaint with the supervisory authority in the manner specified in the provisions of the GDPR Regulation and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Personal Data Protection Office.

  1. In order to exercise the rights referred to above, an appropriate message can be sent by email to the following address: [email protected] or in writing to the Administrator's address: ul. Grzybowa 10, 62-081 Wysogotowo or the data protection officer, indicated at the beginning of this point of the Regulations, may be contacted.

 

VIII. FINAL PROVISIONS

  1. The Organiser reserves the right to change the Regulations at any time. The change does not apply to Participants who have already purchased the Workshops and accepted the Regulations, unless they consent to such a change.
  2. Any disputes that may arise from Workshop Participation are resolved by the court competent for the registered office of the Organiser.
  3. In matters not regulated by these Regulations, the provisions of generally applicable law shall apply, including in particular the provisions of the Civil Code and the Act on consumer rights of May 30, 2014.
  4. The Participant has the right to file a complaint. Complaints must be submitted in writing to the email address: [email protected] within 14 days from the date of the Workshop. The Organiser recommends providing the following data in the description of the complaint: information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of irregularities or lack of compliance with the contract; contact details of the person filing the complaint as this facilitates and speeds up the processing of the complaint. The requirements set out in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.
  5. If the complainant changes the contact details provided while the complaint is being considered, he or she is obliged to notify the Organiser thereof.
  6. The complainant may attach evidence (e.g. photos or documents) related to the subject of the complaint. The Organiser may also ask the person filing the complaint to provide additional information or send evidence (e.g. a photo) if this can facilitate and speed up the processing of the complaint by the Organiser.
  7. The Organiser responds to the complaint immediately, no later than within 14 calendar days from the date of its receipt.
